Terms of Service

Welcome to Means Logistics Ltd ("Means Logistics", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of our website meanslogisticske.com, mobile applications, and logistics services (collectively, the "Services"). By using our Services, you agree to these Terms.

1. Our Services

Means Logistics provides logistics and fulfillment services including:

• Domestic and international shipping & courier services
• Warehouse storage and order fulfillment
• Real-time shipment tracking
• Customs clearance and documentation
• Returns management and reverse logistics

2. Accounts & Eligibility

To access certain Services, you must:

• Be at least 18 years old or have legal capacity to enter contracts
• Provide accurate account information
• Maintain security of your account credentials
• Notify us immediately of any unauthorized use

You are responsible for all activity on your account.

3. Payments & Fees

Payment Terms

All fees are quoted in Kenyan Shillings (KES) and exclude VAT unless stated otherwise. Payment is due:

• Prepaid services: Before shipment
• COD services: Within 7 days of delivery
• Corporate accounts: Per agreed credit terms (30 days max)

Fee Changes

We may adjust fees with 30 days notice. Continued use constitutes acceptance.

4. Shipments & Delivery

When using our shipping services:

• Ensure packages are properly packed and labeled
• Provide accurate delivery addresses and contact details
• Delivery times are estimates, not guarantees
• You must be available to receive deliveries or authorize safe drops

Failed Deliveries

Additional fees apply for failed delivery attempts (KES 200 per attempt after first attempt).

5. Prohibited Items & Uses

You may not ship:

• Dangerous goods (explosives, flammables, corrosives)
• Illegal substances or counterfeit goods
• Weapons, ammunition, or military equipment
• Live animals (except approved service animals)
• Human remains or body parts
• Perishable goods requiring refrigeration

6. Liabilities & Limitations

Maximum Liability: Our liability is limited to 100% of shipment value or KES 50,000, whichever is lower.

We are not liable for:

• Indirect, consequential, or punitive damages
• Delays caused by weather, strikes, or force majeure
• Loss of profits or business interruption
• Improper packaging or inadequate labeling

7. Termination & Suspension

We may suspend or terminate your account if you:

• Violate these Terms or applicable laws
• Fail to pay outstanding invoices
• Engage in fraudulent activity
• Pose safety or security risks

Termination does not relieve you of payment obligations.

8. Disputes & Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved exclusively in the courts of Nairobi County.

For claims under KES 1,000,000, you agree to first attempt resolution through our customer support team within 30 days.

9. Miscellaneous

Entire Agreement

These Terms constitute the entire agreement between you and Means Logistics.

Severability

If any provision is found invalid, remaining provisions remain in effect.

Assignment

We may assign these Terms. You may not assign without our written consent.

Force Majeure

We are not liable for delays caused by events beyond our control.
